Photography services
Katy Webb Photography provides professional wedding photography services in France, across Europe and, where agreed, at international destinations.
The precise services provided to a client will depend on the package, coverage, location and other arrangements agreed between Katy Webb Photography and the client.
Information presented on this website is intended to provide a general description of the photography services. The specific services, deliverables and conditions applicable to a booking are determined by the individual agreement between Katy Webb Photography and the client.
Enquiries and quotations
Enquiries submitted through the website do not automatically create a contract or guarantee the availability of a date.
Availability, pricing and proposed services will be confirmed directly with the client before a booking is accepted.
Any quotation or proposal provided by Katy Webb Photography will be subject to the terms and validity period stated in that quotation or proposal.
Booking and contract
A photography booking becomes binding when the client has accepted the applicable contractual terms and the booking has been confirmed by Katy Webb Photography in accordance with the agreed booking arrangements.
The booking documentation will set out the agreed services, date, location, price, payment arrangements and any other conditions specific to the booking.
In the event of any conflict between these general website terms and a specific signed client agreement, the specific client agreement will apply to the extent of that conflict.
Pricing
Prices for photography services are communicated to clients as part of the enquiry and booking process.
The price applicable to a confirmed booking will be the price agreed between Katy Webb Photography and the client and recorded in the applicable booking documentation.
Where applicable, additional services, travel, accommodation, destination expenses, albums, prints or other products may be charged separately where agreed with the client.
Any applicable taxes or VAT treatment will be determined in accordance with the legal status and tax obligations of Katy Webb Photography at the time of the transaction.
Payments
Payment amounts, deposits or booking fees, payment dates and accepted payment methods will be communicated to the client before the booking is confirmed.
Where a deposit or other advance payment is required, the applicable contractual documentation will specify its amount and the conditions governing the payment.
Any outstanding balance must be paid in accordance with the payment schedule agreed in the booking documentation.
Cancellation by the client
Clients should notify Katy Webb Photography as soon as reasonably possible if they wish to cancel a booking.
The financial and contractual consequences of cancellation, including any applicable refund or retained payment, will depend on the terms of the individual booking agreement and applicable law.
Nothing in these Terms & Conditions is intended to exclude or limit any mandatory consumer rights that cannot legally be excluded.
Rescheduling
Requests to change a booked date should be made as soon as possible.
A requested change of date is subject to availability and may require a new agreement between Katy Webb Photography and the client.
Any additional costs resulting from a change of date or location will be discussed with the client before the change is confirmed.
Illness or inability to provide the service
Katy Webb Photography will make reasonable efforts to fulfil all confirmed bookings.
If Katy Webb Photography becomes unable to provide the photography service due to serious illness, injury or another circumstance that prevents performance, reasonable efforts will be made to identify a suitable professional replacement where appropriate and possible.
Where a suitable replacement cannot reasonably be arranged, the applicable contractual and legal consequences will apply, including any refund that may be required under the booking agreement or applicable law.
Client responsibilities
Clients are responsible for providing accurate information relevant to the booking, including the wedding date, location, timings and other information reasonably required to provide the agreed photography services.
Clients should inform Katy Webb Photography of any material changes to the event arrangements as soon as reasonably possible.
Clients are also responsible for obtaining any permissions required from venues or other third parties where those permissions are necessary for photography to take place.
Venue and event restrictions
Photography may be subject to restrictions imposed by venues, churches, celebrants, registrars, event organisers or other authorities.
Katy Webb Photography will work within reasonable restrictions that apply to the event. Where restrictions materially affect the agreed service, the parties will seek to find a reasonable alternative where possible.
Travel and destination services
For weddings and events outside the photographer's usual working area, travel, accommodation and other destination expenses may apply where agreed with the client.
Any such costs will be communicated to the client before they become part of the agreed booking.
Where travel disruption or restrictions materially affect the photographer's ability to reach a destination, the parties will communicate as soon as reasonably possible and seek a reasonable solution.
Image delivery
Final photographs will be delivered in the format and through the method agreed with the client.
The expected delivery timeframe will be communicated during the booking process. Delivery times may vary depending on the season, workload, complexity of the event and other circumstances.
Katy Webb Photography will make reasonable efforts to deliver the agreed photographs within the communicated timeframe.
Artistic style and editing
Clients acknowledge that photography involves artistic judgement and creative interpretation.
The selection of photographs, composition, colour treatment, editing style and final presentation remain within the professional and artistic judgement of Katy Webb Photography, subject to the services agreed with the client.
Reasonable efforts will be made to accommodate agreed preferences, but specific artistic results or individual photographs cannot be guaranteed.
Copyright
Copyright and other applicable intellectual property rights in the photographs created by Katy Webb Photography remain with the photographer unless otherwise agreed in writing or required by applicable law.
Clients do not acquire ownership of the copyright merely by purchasing photography services or receiving photographs.
Client image usage
Unless otherwise agreed in writing, clients receive a personal, non-exclusive licence to use the delivered photographs for private, non-commercial purposes.
This may include personal printing, sharing with friends and family, and sharing on personal social media accounts, provided that the photographs are not used for commercial advertising, resale, licensing or other commercial purposes without prior written permission.
The licence does not transfer copyright ownership to the client.
Clients should not materially alter, manipulate, sell, sublicense or commercially exploit the photographs without prior written permission, except where permitted by applicable law or expressly agreed in writing.
Portfolio and promotional use
Katy Webb Photography may wish to display photographs from weddings and sessions in its portfolio, website, social media, publications or other promotional materials.
Any such use will be subject to the permissions, agreements and applicable image and privacy rights relevant to the individuals depicted.
Where specific consent or contractual authorisation is required, photographs will only be used in accordance with that authorisation.
Personal data
Personal information provided during enquiries and bookings is processed in accordance with applicable data protection legislation.
Further information about the collection, use, retention and protection of personal data is available in the Privacy Policy.
Consumer right of withdrawal
Where a client is a consumer and a photography services contract is concluded remotely or outside the professional's usual place of business, statutory consumer rights, including any applicable right of withdrawal, will apply in accordance with French law.
Where a right of withdrawal applies, the applicable statutory period, conditions and method of exercising that right will be provided to the consumer before the contract is concluded.
Certain services may be subject to statutory exceptions or special rules. These will be addressed in the applicable booking documentation where relevant.
Force majeure
Neither party will be responsible for a failure or delay in performing contractual obligations to the extent that it results from circumstances beyond that party's reasonable control and which could not reasonably have been prevented or overcome.
Such circumstances may include exceptional natural events, government restrictions, serious illness, major transport disruption, war, civil unrest or other events recognised as force majeure under applicable law.
The affected party will notify the other party as soon as reasonably possible and the parties will seek an appropriate solution in good faith.
Liability
Katy Webb Photography will perform its contractual obligations with reasonable care and professional skill.
Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
Katy Webb Photography cannot be responsible for circumstances caused by third parties, venue restrictions, client actions or other circumstances outside the photographer's reasonable control, except where liability cannot legally be excluded.
Complaints
Clients who have concerns regarding a photography service should contact Katy Webb Photography as soon as reasonably possible so that the matter can be reviewed and, where appropriate, resolved directly.
Consumer clients retain any mandatory rights concerning complaints, mediation and dispute resolution available under applicable French law.
Consumer mediation
Where required by applicable French consumer law, eligible consumer clients may have the right to refer a dispute to an appropriate consumer mediator after first attempting to resolve the matter directly with Katy Webb Photography.
The relevant mediator and applicable procedure will be identified in the contractual or pre-contractual information provided to the client where required by law.
Applicable law
These Terms & Conditions are governed by French law, subject to any mandatory consumer protection provisions that may apply.
Where a dispute arises, the parties will seek to resolve it amicably wherever reasonably possible before pursuing formal proceedings.
Nothing in these Terms & Conditions prevents a consumer from exercising any mandatory rights concerning jurisdiction or dispute resolution provided by applicable law.
Changes to these Terms & Conditions
These Terms & Conditions may be updated from time to time to reflect changes to the services, website, applicable law or business practices.
The version applicable to a particular booking will be determined by the contractual documentation accepted by the client.
